MOTION FOR TERMINATION OF CURRENT CHILD SUPPORT AND
FOR ESTABLISHMENT OF PAYMENT PLAN ON ARREARS

Petitioner, ____________________ (the "Obligor"), respectfully moves this Court for an order terminating current child support and establishing a payment plan on arrears, and in support states:

1.  Both children of the parties have attained the age of eighteen (18) years,
    the age of majority under Florida law. See section 61.13(1)(a)1.a.,
    Florida Statutes. Neither child is enrolled in high school with a
    reasonable expectation of graduation before age nineteen (19).

2.  The 2017 Order provided for child support in the amount of $400.00 per
    month for two children, with a step-down to $300.00 per month upon the
    emancipation of the first child. That step-down was never implemented
    by the enforcing agency.

3.  The younger child turned eighteen (18) on ____________, 20__. Under
    Florida law, the current support obligation terminates as of that date.

4.  The issuing state of the controlling order is Florida. Under UIFSA
    § 604(a), the duration of the support obligation is governed by
    Florida law, not by the law of the responding state (Massachusetts).
    Section 88.6041, Florida Statutes.

5.  The Obligor owes accumulated arrears of approximately $6,000.00.
    Section 61.14(10), Florida Statutes, provides that upon termination
    of current support due to emancipation, the obligor "shall continue to
    pay at the same rate in effect immediately prior to emancipation until
    all arrearages... are paid in full or until the amount of the order is
    modified."

6.  The Obligor requests that this Court enter an order:
    a. Terminating current child support effective ____________, 20__;
    b. Adjudicating total arrears in the amount of $________;
    c. Establishing a payment plan on arrears of $100.00 per month; and
    d. Directing the Florida Department of Revenue and the Massachusetts
       Department of Revenue to update their records accordingly.

ORDER GRANTING TERMINATION OF CURRENT CHILD SUPPORT AND
ESTABLISHING PAYMENT PLAN ON ARREARS

THIS CAUSE came before the Court on ____________, 20__, upon the
Supplemental Petition/Motion of the Obligor for termination of child
support. The Court having reviewed the file and being otherwise fully
advised in the premises, it is

ORDERED AND ADJUDGED:

1.  The obligation to pay current child support, previously set at
    $400.00 per month, is TERMINATED effective ____________, 20__, the
    date of the younger child's eighteenth (18th) birthday.

2.  Total child support arrears owed by the Obligor through the
    termination date are adjudicated in the amount of $________.

3.  Beginning ____________, 20__, the Obligor shall pay One Hundred
    Dollars ($100.00) per month toward the arrears, payable to the
    Florida State Disbursement Unit, until such arrears are paid in
    full.

4.  Any Income Deduction Order previously entered in this cause is
    modified to reflect the termination of current support and to
    establish withholding only for the arrears payment of $100.00 per
    month.

5.  The Clerk of Court shall furnish a copy of this Order to the
    Florida Department of Revenue and to the Massachusetts Department
    of Revenue Child Support Enforcement Division.
